Minimum wage
Until the end of 2021, there were specific minimum wages for the German construction industry. Since 2022 a statutory minimum wage has come into effect in Germany. This is the minimum wage your employer must pay you while you are working in Germany.
Supplements
While you are posted to a construction site in Germany, you are entitled to supplements for any overtime, night work and work on Sundays and public holidays. There are also hardship allowances.
Posting costs and accommodation
Posting costs (the costs incurred for travel, meals and accommodation) are not covered by the minimum wage. Your employer must give you this money in addition to the minimum wage.
Does your employer give you an additional allowance during your posting to Germany? Similar to the posting costs, they must pay this allowance in addition to the minimum wage.
Exception: You have agreed otherwise with your employer in your employment contract.
If your employer provides you with accommodation, it must comply with the German Workplace Regulation (Arbeitsstättenverordnung - ArbStättV). For example, the accommodation must have a living and sleeping area with beds, tables, chairs and cupboards, and there must be a bathroom (sanitary facilities).
Posting for more than 12 months
If you are posted to Germany for more than 12 months, you will be subject to the same working conditions as German workers. Your employer can extend this period to 18 months. For that, they must inform Customs of the reasons for extending the posting period.
